notes: 4/6/14

people wont think to treat others different just cause the federal government says they should. you can't change morality by passing a law. the law can restrain you from acting a certain way.

1870's-1950's no law was passed in regards to civil rights. The Civil Rights Act of 1964
changed public services, voting provisions,federal funding programs, employers and labor unions could not discriminate. could not discriminate against race, ethnicity, gender or religion.
                                                          Civil Rights Act of 1968"open housing act."
cannot refuse selling rent living space to a person due to race, religion, national origin, disability, ect. housing is still one of the most segregated areas in American life today.
                       Title 9: forbids discrimination on the basis of gender in any educational program or regarding financial assistance. equal funding required.
              Affirmative Action: requires employers to not discriminate, be positive. employers must meet quotes for minority groups/genders.

        Many argue in reverse discrimination against the minority group. they are denied oppertunities so minority groups have more opportunities. "color blind" -base them off skills, not looks.
 Cali, mi, wash, &Nebraska voters passed measures to eliminate all affirmative action plans.

                                     The Bakke Case: Allan Bakke sued the University of California because he was denied access to their medical school due to Affirmative action 16/100 seats were reserved for minority students. Bakke won the case.
  Since then the court has made decisions regarding similar cases.



             Justice Sandra Day O'Connor predicts in 25 years, the use of racial preferences will no longer be necessary.
